Cops: Man accused in years old rape

Suspect, Rafael Miranda-Carbajal, 27, was living with alleged victim and her mother, cops say

EDWARDS — An Edwards man faces charges of sexual assault after he allegedly raped and touched a young girl several years ago, the Eagle County Sheriff’s Office reported.

Rafael Miranda-Carbajal, a 27-year-old illegal immigrant, is accused of sexual assault of a child under 15 and is being held in Eagle County jail on $50,000 bond, the sheriff’s office said.

Miranda-Carbajal raped the girl once and touched her several times five to six years ago, while living in Edwards with the girl and her mother, according to an arrest affidavit by Sheriff’s Detective Doug Winters.

He denied raping the girl in a phone conversation with the alleged victim’s mother.

Both names were withheld to prevent identification of the girl. The girl, now 15, recently became upset and for the first time told her mother about the alleged rape.

Miranda-Carbajal and the girl wrestled five or six times and he either removed her clothes or asked her to remove them, the affidavit says.

The wrestling stopped if her mother came home, the affidavit says.

Once, Miranda-Carbajal touched the girl while she was taking a bath; on another occasion, he lead the girl into his bedroom wearing just a towel and raped her, the affidavit says.

The mother called Miranda-Carbajal Jan. 18 at an investigator’s prodding. The mother asked several pointed questions about the alleged sexual attacks in an attempt to draw out a confession.

Miranda-Carbajal denied rape, but admitted to touching the girl, the affidavit says.

“No I did not rape her, yes I touched her, her parts her breasts while playing I would grab her from there,” Miranda-Carbajal said, according to a phone transcript included in the arrest affidavit.

Deputies obtained a warrant for Miranda-Carbajal and arrested him on Jan. 19.
