Avon postal worker showed off genitals, D.A. says

Postal worker’s employment status undecided pending internal investigation

EAGLE, Colorado — A postal employee who showed his genitals to two women employees at the Avon Post Office was sentenced to probation and community service Monday, the Eagle County District Attorney’s Office said.

Avon police accused Randal C. Tolbert, 55, of two misdemeanor counts of indecent exposure June 14, according to an Avon Police Department report.

Tolbert had exposed his genitals to two women on two separate occasions, authorities said.

One of the women told police that Tolbert asked her to come to the back to the mailroom in mid-March 2007, the police report said. Tolbert was behind some mail carts and grabbed the back of the woman’s head and pulled her over the carts. She saw his penis, the report said.

The woman told a co-worker, also her friend, about the incident and that woman said Tolbert also had showed his penis to her a “long time ago,” the report said.

Prosecutors had filed two counts of public indecency against Tolbert, but dropped one in exchange for Tolbert’s guilty plea to one count of public indecency, a petty offense, the District Attorney’s Office said.

On Tuesday, Tolbert was sentenced to 96 hours of community service, one year of probation and $517 in court costs and fines.

“There’s a record that he did this so we’re satisfied,” said District Attorney Mark Hurlbert.

Prosecutors had evidence that Tolbert showed his genitals to two women, Hurlbert said.

Telephone calls to a number listed in the phone book as Tolbert’s were not answered Tuesday evening.

At first, U.S. Postal Service investigators found that Tolbert did not show his genitals to one of the women in a month-long investigation, said Al DeSarro, spokesman for the postal service. Another internal investigation was launched after the postal service learned new information, DeSarro said.

Tolbert has not been fired. A decision on Tolbert’s employment status will be made once the new investigation — which will take into account findings from the “legal process” — is completed, DeSarro said.

“We will review everything,” DeSarro said.

Tolbert had been on leave at one time, said DeSarro, who could not confirm whether Tolbert had returned to work because managers at the Avon Post Office could not immediately be reached for comment late Tuesday afternoon.
