Domestic abuse charges filed against commissioner candidate

EAGLE - An Eagle County commissioner candidate is calling domestic violence charges "unfounded."

Michael Shayne Mitchell faces three misdemeanor charges stemming from an incident Sunday morning involving his ex-wife and their daughter.

"It is an accusation and in my opinion completely unfounded," Mitchell said.

About 11 a.m. Sunday, Eagle police were called to the scene to meet with Michael Shayne Mitchell, according to Eagle Police Det. Paul Arnold's report.

Mitchell was mowing the lawn when Arnold arrived, the report said.

Mitchell led Arnold into the house so Arnold could interview his ex-wife and their daughter.

Mitchell and his daughter were arguing over chores, the daughter told police. When his daughter turned to walk away, Mitchell grabbed her by the shoulders. She struggled to get away and hit Mitchell in the arms, she told police.

She said Mitchell slapped her across the face, causing her nose to bleed, according to the daughter's statements to police.

His daughter told police she locked herself in the bathroom, and later her bedroom.

A few minutes later she heard her mother and father arguing outside the door, the police report said. She told Arnold she called police because she feared for her and her mother's safety.

His ex-wife told police she was planting things in the garden and listening to music. She said she heard her daughter scream and looked up to see her struggling with Mitchell.

She said Mitchell left, and then returned before police arrived.

Mitchell faces three misdemeanor charges: child abuse, knowingly and recklessly causing bodily injury, a class 1 misdemeanor; third degree assault, a class 1 misdemeanor; menacing, a class 3 misdemeanor; and domestic violence.

He made his first court appearance Monday morning before Eagle County Court Judge Katharine Sullivan.
