This letter is directed toward all tipped employees and their employers. After asking around to friends who work in a couple of different restaurants, I realized that several restaurants and bars are not paying their employees fairly according to Colorado law.
A state law took effect Jan. 1 that obligates employers to pay a minimum wage of $4.76 to all tipped employees. The law is called Colorado Minimum Wage Order 29. If you go to the Colorado state website (www.colorado.gov) and do a search for "tipped employee minimum wage," the first link that comes up will take you to a page containing this new law.
This letter is not meant to accuse anyone of wrongdoing, but to educate employers and employees to this new law so that everyone is aware of this issue.
I'm writing this letter on behalf of a friend who is afraid to approach her boss about this for fear it may affect her employment. I decided to get this printed in the paper in case there are others who have the same worries with their employers.
If you are a tipped employee, check your paycheck to be sure you are being paid fairly. If you are an employer, do the right thing and pay your employees what they are legally owed.
