Eagle announces vital water rights decree

The town of Eagle has announced a vital water court decree transferring substantial agricultural water rights to its municipal water rights portfolio.

“This is a very important achievement that will benefit the town forever. Water is one of the life bloods of our community,” said Eagle Tow Manager Jon Stavney.

The decree, made by the State of Colorado District Court in and for Water Division No. 5, concludes a marathon process which started in 2005. During that time the town water rights team had to negotiate and address concerns of nine objectors through a strenuous negotiation process

The water rights connected with this decree were acquired by the town during the annexations of Eagle Ranch and the Brush Creek Meadows Subdivision and are some of the most senior rights on Brush Creek.

Incorporating these water rights into the town’s portfolio will accomplish important goals of the town including:

Solidifying its overall water rights portfolio.

Making the town the dominant holder of water rights on Brush Creek.

Improving the administration of the Brush Creek Watershed Management Plan.

Providing domestic water and irrigation for our future growth.

Importantly, the decree allows these water rights, as well as the town’s existing municipal water rights, to be used at its existing Upper Basin Water Treatment Plant and its planned Lower Basin Water Treatment Plant. The ability to use in either location will allow the town to better administer flows in Brush Creek for the health of the aquatic environment.

The town’s water rights team consists of Stavney, public works director Dusty Walls, former town manager Manager Willy Powell, Michael Erion of Resource Engineering and Mary Elizabeth Geiger of Garfield and Hecht, P.C.
