I think you missed the other edge of that sword, though. Well-funded, recreational litigators (serial litigators, pick a term) frequently use-misuse the legal system as a tool to blackmail and bully political opponents.-
There is virtually no consequence to battering people and institutions at a whim, particularly if the “gadfly” would rather pay lawyers than engage in other forms of “entertainment.”-
Individual targets of these suits are forced to spend money and time to defend themselves. Institutional defendants end up diverting scarce resources best used in other ways. (Can you tell that I’d rather the school district be hiring teachers than lawyers?)-
Now, if the system provided that a losing plaintiff had to pay the other sides legal fees. S Hey, a guy can dream.
