Attempted murder charge avoided
EAGLE ” Modesto Lujan avoided an attempted murder charge after being accused by deputies of driving over his girlfriend Oct. 17, the Eagle County District Attorney’s Office reported.
Deputies arrested Lujan, 45, for attempted murder, but prosecutors dropped the charge when they determined there was insufficient evidence to prove Lujan intended to kill his 55-year-old girlfriend, District Attorney Mark Hurlbert said.
“At this time we can’t show that he intended to kill her,” Hurlbert said. “Certainly he meant to hurt her, but we can’t prove he meant to kill her.”
Lujan faces charges of first degree assault, vehicular assault and drunk driving. He remains in Eagle County jail on $500,000 bond.
Lujan and his girlfriend, whose name has not been released, were arguing inside his truck the night of Oct. 17. He pulled the car over on Colorado River Road and both stepped outside, where the argument escalated into a fight, police said. Lujan returned to the car and allegedly ran over his girlfriend an unknown number of times.
The woman is being treated at a Denver hospital. Her condition, critical but stable this time last week, could not be ascertained Monday evening.
