Avon passes pot shop moratorium

AVON – Town Council on Tuesday approved a temporary, 200-day moratorium on the submission, acceptance, processing and approval of all applications for permits and licenses related to medical marijuana dispensaries.

The town previously denied an application for a dispensary license because it did not comply with the town’s land use code.

A recent ruling by an Arapahoe County Court held that home rule municipalities, which Avon is, cannot enforce federal laws and cannot prohibit medical marijuana dispensaries from opening. In light of the Arapahoe County decision, Avon is instituting a moratorium in order to allow the town time to draft, propose, debate and adopt appropriate regulations in order to comply with the law and this new ruling.



In November 2000 Colorado voters enacted Amendment 20 which authorizes and limits the sale of medical marijuana for use in the treatment of debilitating medical conditions.
