EAGLE COUNTY, Colorado ” Charges were dropped Tuesday against musician William McKay, who was arrested last month after being accused of drugging and sexually assaulting a woman in Edwards.

District Attorney Mark Hurlbert said there wasn’t enough evidence to mount a formidable case against McKay, who is well-known for his keyboarding and vocals in bands such as Leftover Salmon, the Derek Trucks Band, Double Parked and the Bill McKay band.

There were several factors in the decision not to pursue charges against McKay, 39. For one, the woman claimed she was sexually assaulted after McKay performed a New Year’s concert at an Edwards restaurant but police were not called until Jan. 9.

And if she was drugged, Hurlbert said, any signs of drugs in her system would’ve been long gone by that time. Hurlbert also said the woman didn’t remember much from the evening.

“You couple those together and it makes it really difficult to build a case,” Hurlbert said.
