Charges filed in alleged murder-for-hire plot against Aspen DA

DENVER, Colorado ” The ex-wife of Aspen prosecutor Richard Nedlin was charged Thursday with two felonies for allegedly plotting to kill him.

Elinor Dvir, 36, stands accused of solicitation of first-degree murder and solicitation of first-degree assault, based on documents filed with Jefferson County Court. Judge Tom Vance advised Dvir of the counts against her at a morning hearing.

She faces more than 20 years in state prison if convicted as charged. Dvir appeared via video monitor from the Jefferson County jail where she has been held since being arrested Sunday.



She is being held on $100,000 bond.

Dvir also was found to be indigent, said Pam Russell, a spokeswoman for the Jefferson County District Attorney’s Office.

That led to the appointment of a public defender in the case. Russell said the next court date is March 27, at which time a preliminary hearing is likely to be set in the case.

“That is not an appearance date for her,” Russell said.

Investigators from the Jefferson County District Attorney’s Office arrested Dvir at her Denver home one day after she allegedly offered $2,000 to an undercover officer to kill Nedlin.

Dvir allegedly told the undercover officer she wanted the murder to look like an accident, according to an arrest affidavit filed in the case. She offered details about the prosecutor’s residence, family and other particulars.

Dvir also suggested she was motivated by a custody battle with Nedlin.

“Elinor said her attorney told her that the only way you’re going to get your daughter is if he’s gone,” the affidavit states. “Elinor said ‘no it can’t look like I am involved because I lost my daughter.'”

A police informant, who told authorities he had communications with Dvir about killing Nedlin, unveiled the alleged murder scheme.

The informant told authorities he met with Dvir at a bar in Lakewood in late February, where she was “pestering” him about “taking out” Nedlin. The informant said he met Dvir through the Denver Metro VIP Escort Service.

She apparently worked for the company as an escort, the affidavit states.

The informant allegedly had numerous conversations with Dvir over a two-week period about “hits,” with the last one coming March 6.

That is when the informant apparently told Dvir that he wanted her to meet his partner, who would be responsible for doing the “job.” The partner was the undercover officer, the affidavit stated.

A meeting was subsequently arranged between the undercover officer and Dvir at her home Saturday on South Grant Street in Denver. Dvir was arrested the following day.

Nedlin has declined to comment on the issue.
