Colo man sues dog owner over bicycle accident

BOULDER, Colo. – A man who injured his leg after a dog ran into his bicycle is suing the animal’s owner for medical expenses.

Sixty-six-year-old Gary Abbuhl says in his lawsuit that he incurred almost $43,000 in medical bills because of the accident in which he broke his leg last year. He says the dog’s owner is responsible and alleges the dog was not properly restrained.

Abbuhl filed his lawsuit last week in Boulder County District Court.

The dog was a Cavalier King Charles spaniel. The owner, Kelly Engholt, says her dog weighs about 10 to 12 pounds and is considered a toy breed. Engholt pleaded guilty to failing to property control and restrain her dog and was fined $325 in addition to being put on unsupervised probation for a year.
