DA: Gross won’t face death penalty

EAGLE- The man accused of killing Maria Madrid will not face the death penalty, said District Attorney Mark Hurlbert.

Charles Gross was arrested last Oct. 10 and charged with the murder of Maria Madrid. He is accused of shooting the 35-year-old women as she left a campsite on Coffee Pot Road north of Dotsero. Madrid’s husband and son said Gross accused them of not cleaning up their campsite after they picnicked

there Oct. 7.

Hurlbert met with Madrid’s family Thursday to discuss whether he should seek the death penalty.

“It’s not something to go into lightly,” Hurlbert said.

After explaining it would be very hard to get a jury to impose the death penalty, Madrid’s family and Hurlbert decided to seek a life sentence without the possibility of parole.

Gross’s preliminary hearing is set for Monday at the Eagle County Combined Courts in Eagle.
