Eagle County: Women sues man after guilty plea

EAGLE, Colorado ” A lawsuit has been filed against a man who pleaded guilty in January to inappropriately touching a woman in Red Cliff, authorities said.
The woman, whose name is being withheld, filed a lawsuit accusing Albert A. Quintana, 34, of Eagle County, of “forcibly” coming into her home on Feb. 11, 2007. Quintana had no criminal record in Eagle County at the time.
Quintana “physically harmed and injured” the woman, “causing her pain, injury and emotional distress,” the lawsuit says. The woman wants compensation and attorney’s fees, the lawsuit says.
Quintana denies the allegations in his answer to the woman’s complaint, says the lawsuit, filed April 4 in Eagle County District Court. The woman and Quintana want to go to trial, the lawsuit says.
Billy-George Hertzke, Quintana’s defense attorney, declined comment.
“We’re still investigating this case, and it’s not appropriate to comment at this time,” Hertzke said.
Quintana pleaded guilty Jan. 3 to “overpowering her and touching her inappropriately” without the woman’s consent, Eagle County Assistant District Attorney Karen Romeo has said.
Quintana was sentenced to 60 days in jail and four years of sex offender probation March 12 after he pleaded guilty to misdemeanor unlawful sexual contact.
He also was ordered to register as a sex offender.
Richard Dally and Jawn Ross, the woman’s attorneys, were unavailable for comment.
