Topic: Review of ordinance denial related to Buffalo Bar and Grill. At the last meeting, the Gypsum Town Council denied a request to amend an ordinance of the Gypsum Municipal Code that would reduce the distance from 500 feet to 200 feet required between schools and establishments licensed to sell beer and wine.
Issue: The new Gypsum restaurant wanted this amendment to ensure that they could serve beer and wine with food in the establishment, which is located less than 500 feet from the Eagle Valley High School campus. The motion failed with a 3-3 vote at the last town council meeting.
Discussion: In the past, council members expressed concern about making an amendment to a state law, in addition to setting a precedent related to the issue. The owners did extensive research and made changes to their request before asking for reconsideration. “I was one who denied it … but it’s been proven to me that this could be successful without any problems,” said Mayor Steve Carver.
Decision: The amendment will be put back on the agenda for the next meeting.
