Federal court considering Colorado smoking ban
DENVER, Colorado ” Opponents of Colorado’s statewide smoking ban are planning to make their case to a federal appeals court, hoping the judges will overturn the law.
Oral arguments are scheduled for Thursday morning.
Owners of bars, taverns, bowling alleys and other businesses where smoking is now prohibited say the ban discriminates against them because some other businesses are exempt.
Casinos, cigar bars and the smoking lounges at Denver International Airport were exempted when the ban took effect last summer.
However, lawmakers later voted to extend the ban to casinos. Cigar bars and airport smoking lounges are still exempt.
A federal judge rejected their challenge last year, and they appealed.
