Frisco boater charged with vehicular homicide

SUMMIT COUNTY, Colorado ” A Frisco man faces a new charge of vehicular homicide in the drowning death last month of a passenger on a rented boat at the Dillon Reservoir.

Kevin Lukanski previously was charged with boating under the influence in the Aug. 6 accident when his friend, Adam Brown, fell from the boat as they returned to Frisco from Dillon.

Lukanski was released from the Summit County Jail that same evening on $1,000 bond.

Brown remained missing in the reservoir for three days before rescue crews discovered his body in 47 feet of water.

“After the thorough investigation by the Summit County Sheriff’s Office, we felt that this was more than simply an accident,” said District Attorney Mark Hurlbert.

“Rather, Mr. Lukanski committed vehicular homicide.”

Vehicular homicide is a Class 3 felony and, if convicted, Lukanski could face fines from $3,000 to $75,000 and a possible prison term of four to 12 years.

Under state law, a boat is considered a motor vehicle, and the homicide charge would be the same had Lukanski been driving a car under the influence.

A court date for both the vehicular-homicide charge and the boating-under-the-influence charge has been scheduled for 1:30 p.m. on Sept. 17 in Summit County District Court.
