Gypsum man arrested for sex assault

GYPSUM ” A Gypsum man was arrested for allegedly sexually assaulting his ex-wife in his home early Sunday.
A woman, 52, told police that Richard Bisant, 54, of Gypsum, sexually assaulted her in her room about 1:30 a.m., according to an Eagle County Sheriff’s Office report. The woman called police and hung up the phone, prompting a visit from a sheriff’s deputy, the report said.
Bisant and the woman, whose name is being withheld, were arguing in Bisant’s home when an Eagle County sheriff’s deputy arrived. Approaching the home, the deputy heard the woman saying, “‘I did not want to have sex with you. You were holding me down and forcing yourself on me.”
“‘I tried to rape you, but you called the cops,'” Bisant told the woman, the report said.
The deputy knocked on the door and saw the naked Bisant fall several times as he tried to put on his pants, the report said. Bisant answered the door and the deputy handcuffed Bisant, who was allegedly drunk.
The woman was in her bedroom when Bisant walked in her room naked and asked her for sex, she said. The woman said no and Bisant got on top of her and held her arms down, the report said.
The woman told him to get off and when she broke free, she called police, but hung up the phone when she saw that Bisant had left the room, the report said.
The woman earlier drank some alcohol with Bisant, but she was “‘not as drunk as I thought I was,'” she told the deputy.
Asked by the deputy whether he tried to have sex with the woman, Bisant said, “‘I tried but (it) did not work out.'”
The ex-wife had been staying with Bisant because she was having trouble finding a job, the report said. She has not had sex with Bisant since they were divorced about seven years ago though she was “OK with cuddling with Richard,” the report said.
Scratches were found on Bisant’s side and back at the Eagle County jail.
Bisant was arrested on suspicion of felony sexual assault and criminal attempt to commit, both felonies, and domestic violence and harassment, both misdemeanors.
Bisant paid a $7,500 bond and was released from the Eagle County jail, said Kim Andree, spokeswoman for the Eagle County Sheriff’s Office.
The woman would not pursue criminal charges against Bisant, the report said.
Bisant did not return a call requesting comment.
