Homeowner cleared in fatal shooting

DENVER – A homeowner who shot and killed a 17-year-old intruder will not face charges.

Marcus Duran died after being shot in the head during an attempted burglary May 24.

Denver District Attorney Mitch Morrissey Friday said the homeowner’s use of deadly force falls under Colorado’s “Make My Day” laws that allow the use of deadly force to protect life or property.



Morrissey’s office reviewed the case because Duran died while he was outside the house on the porch. There were also two alleged accomplices attempting to rob the house, authorities said.

Morrissey said the shooting was justified because the homeowner faced multiple unknown intruders, including one whom was armed with a loaded handgun.
