Letters: Can Eagle County boy be sued?
Vail CO, Colorado
I write to clarify my statement to reporter Steve Lynn in the article published on December 20.
In that article I answered a question about the capacity of a minor child to be sued. In general, Colorado law provides that a minor child may not be sued directly, according to Colorado Revised Statute 13-22-101.
My statement concerned a technical aspect of the case ” who is the named defendant. My comments did not address the underlying merits of the case, nor did I intend to suggest that the plaintiff’s case cannot succeed. Moreover, I did not intend to opine on Colorado law concerning ski safety, including any application of the Ski Safety Act.
Finally, I would like to clarify that in no way did I intend to impugn the integrity of the plaintiff’s lawyer.
