Litigation ties up Minturn funds

MINTURN, Colorado “-The town’s land use attorney updated the Minturn Town Council Wednesday night on the status of Ginn’s current litigation and funds promised to the town.

The Ginn Co., which intends to build a ski resort and golf course, is still tied up in litigation with a plaintiff who claims they own land on the Ginn property. The judge in the case has already ruled against the plaintiff several times, land use attorney Boots Ferguson said. The plaintiff started the lawsuit by claiming to own all the property, then reduced it to 11 acres and now, the claim is down to 7 acres.

In regards to the $11.6 million in an escrow account, Ginn has promised the town, Ferguson said the current litigation is holding up the release of those funds.
