Local man faces 2 years for ‘inappropriate touching’

EAGLE, Colorado ” A man who inappropriately touched a woman in Red Cliff faces up to two years in jail after he pleaded guilty to a misdemeanor Thursday, authorities said.
Albert A. Quintana, 33, was accused of sexually assaulting a woman Feb. 16. Quintana had no criminal record in Eagle County at the time.
Quintana was originally charged with felony sexual assault, Assistant Eagle County District Attorney Karen Romeo said.
“What he plead guilty to was overpowering her and touching her inappropriately” without the woman’s consent, Romeo said.
Quintana’s Denver-based defense attorney, David Kaplan, did not immediately return a message left at his law firm Wednesday afternoon.
Quintana pleaded guilty to unlawful sexual contact Thursday and will have to register as a sex offender, Romeo said.
Deena Ezzell, victim’s service coordinator for the Eagle County Sheriff’s Office, has said the woman knew Quintana. The woman’s name is being withheld.
Prosecutors accepted the guilty plea instead of going to trial, which was scheduled to begin Monday, authorities said.
Sexual assault cases can be difficult to win at trial, Romeo said.
“We always have to decide if the risk is worth it or not, and this is a certain result,” she said.
Quintana faces two years in jail and up to a $5,000 fine, or probation and a shorter time in jail or just probation, she said. Prosecutors will decide what punishment to recommend to a judge after Quintana is psychologically evaluated and after an investigation is done to recommend what his sentence should be, she said.
Quintana has been out of Eagle County jail on bond and is scheduled to be sentenced March 12, authorities said.
