The proposal is on property consisting of about 26,000 square feet. The applicant is proposing to continue using this land as a public parking lot for the Town. The application is for a Conditional Use Permit in a Planned Unit Development Holding Zone per Section 16.12.4 for parking on leased property from the Union Pacific Railroad.Discussion: The applicant has submitted the required documentation for a Conditional Use Application as stated in the Town of Minturn Zoning Regulations. The application is complete and is found to comply with the guidelines, codes and other regulations of the Town. Recommendation:The Planning and Zoning Commission grant a recommendation for approval to the Town Council for a Conditional Use permit with conditions. ACTION ITEM #2 CONDITIONAL USE REVIEW Applicant: Eagle Valley InvestmentsAddress of Property: 421 and 431 Main StreetZoning: Old Town Character Area in a Commercial zoneProposal: The applicant is requesting approval for three conditions in this application: 1.Commercial use over 2,500 square feet2.Residential multifamily in a commercial zone3.Constructing a parking structure in a commercial zoneSummary: Eagle Valley Investments, applicant is requesting Conditional Use approval for a commercial building over 2,500 square feet, for multifamily residential, and a parking structure. Discussion: The applicant has submitted the required documentation for a Conditional Use Application as stated in the Town of Minturn Zoning Regulations. The application is complete and is found to comply with the guidelines, codes and other regulations of the Town. Recommendation:The Planning and Zoning Commission grant a recommendation for approval to the Town Council for a Conditional Use permit with conditions. ACTION ITEM #3 FINAL PLAT Applicant: C & B Development Corporation LLCAddress of Property: 100 block of Taylor StreetZoning: Game Creek Character Area Residential Proposal: Minturn Towne Homes is requesting approval of a Final Plat Subdivision for 26 unit townhomes located on lots 1 through 10 of Block A, Taylor Addition in the 100 block along Taylor Avenue. Summary: On December 3, 2003, the Planning and Zoning Commission reviewed the PUD Concept Plan and recommended approval to the Minturn Town Council. On December 17, 2003, the Minturn Town Council approved the Minturn Towne Homes PUD Concept Plan. On July 7, 2004, the Town Council approved the Preliminary PUD Plan and Preliminary Plat. Discussion: Staff review of this application includes a comparison of the policies outlined in the Comprehensive Plan, pertinent zoning regulations, background activity, and analysis of referral comments including a comparison of the project to policies and goals outlined in the Minturn Land Development Code. The applicant has demonstrated meeting the Final Plat requirements as stated in Section Sec. 17-135. Final plat application of the Minturn Zoning Code.Recommendation:The Planning and Zoning Commission grant approval to the application for a Final Plat application.
