Eagle-Vail man gets 3 years for attacking girlfriend
Vail, CO Colorado
EAGLE , Colorado ” A man who fractured his girlfriend’s skull was sentenced Wednesday to three years in prison and court costs, authorities said.
“That’s great considering what he did to his girlfriend,” Eagle County District Attorney Mark Hurlbert said about Winters’ sentence.
Jeffrey Stephen Winters, 39, of Eagle-Vail, broke an orbital bone in his girlfriend’s face and tried to strangle her July 21, authorities said.
Winters pleaded guilty to misdemeanor third-degree assault Nov. 28 and was convicted of a felony, for which he was on probation from a 2004 domestic violence case, Eagle County District Attorney Mark Hurlbert has said.
Winters was originally facing a minimum of six years in prison on a felony second-degree assault charge and the felony from the 2004 case if a jury had convicted him at trial, said Winters’ defense attorney, Jim Fahrenholtz.
“The plea agreement saved him potentially a minimum of three years and most likely a lot more than three years,” Fahrenholtz said.
Winters and his girlfriend, whose named is being withheld, were at Montauk Seafood Grill around 9 p.m. July 21.
Winters yelled racial slurs at a black employee and Winters told the employee he would have him hanged, an arrest affidavit says. Winters and his girlfriend left.
The girlfriend later came back to the restaurant without Winters. Her face bleeding and with a bruised eye, the girlfriend told an employee that Winters tired strangled her, the affidavit says.
