She stated the incident occurred in Cordillera, Edwards, County of Eagle, Colorado. I advised her to get more information and I would assist her.A short time later. Deputy Rich called me back and stated the victim was sexuallyassaulted las: night (06/30/03) at the Lodge at Cordillera, located at 2205 Cordillera Way.Edwards, County of Eagle, Colorado. She stated that the victim knows the suspect. She stated the victim’s mother wanted us to respond to (redacted) to speak with their daughter.At approximately 1345 hours on 07/01.03, Deputy Rich and I met with (redacted) at her residence. (redacted) We also met with mother and father respectively.I explained that I would like to do a more detailed interview at the Sheriffs Office on video. (redacted) and the rest of the family agreed.Before we left the residence. Deputy Rich and I conducted a brief interview of (redacted). I asked her to tell me what happened. She stated on 06/30/03 she was at work at the Lodge of Cordillera. She stated Kobe Bryant (redacted) checked into the lodgefor the night. I had to have (redacted) explain who the person was again became I didnt quite understand what she was saying. She stated “Kobe Bryant, the basketball player”.(redacted) stated after Bryant checked into the room, he raped her. She stated the sexual encounter was not consensual and wanted to report the event. I explained to (redacted) and her parents, that if this is a false allegation that she could be held responsibie. (redacted) understood and staled the incident really happened. Deputy Rich and I left the residence and met with (redacted) at the Sheriffs Office.The interview (redacted) was video taped. The following information provided is only a summary of what was said and some segments may not be chronological, Present during the interview was myself, Deputy Rich, Nicole Shanor with ihe Resource Center of Eagle County and (redacted). She has been employed there since 05/19/03. She stated she worked on 06/30/03. She stated she got to work about 1400 hours on that date. She was supposed to be at work 1100 hours, however, she had car problems and couldn’t make it to work until 1400 hours.(redacted) stated the day started slowly. She stated around 1600 hours a person named “Pat” called and wanted to confirm a reservation for Javier Rodriguez. She stated she asked more questions and “Pat” finally told her the person coming to the lodge was Kobe Bryant.I asked (redacted) how she knew Kobe Bryant. She stated he’s a basketball player for the Los Angeles Lakers. She stated she decided to stay and meet with Bryant because she wanted to meet him. She stated she was supposed to end work at 1900 hours, however, she stated she was also trying to make up hours missed.(redacted) stated around 2130 hours, Bryant and 2 other people with Bryant arrived at the lodge. She stated she escorted Bryant and the other 2 parties to Bryant’s room, which was room # 35. She stated while in Bryant’s room, Bryant spoke with her. She stated heasked her to come back in a while to show him around the facility.(redacted) stated she left Bryant’s room and retrieved the other 2 keys for the other 2 people with Bryant She stated she escorted them to their respective rooms.(redacted) stated a few minutes later, she walked back to Bryant’s room. She stated she long way because the other 2 parties with Bryant were in the lobby and were not allowing anyone towards Bryant’s room. She stated since Bryant pulled her aside when she was in his room, she didn’t think the other 2 people with Bryant would let her through. She knows mis because the bellman, Robert Pietrack, known by her as Bob, was trying to go through and they wouldn’t let him.(redacted) stated she knocked on Bryant’s door and gave Bryant a tour of the lodge. She stated during the tour, Bryant and her met with Pietrack. They had small talk and then Bryant wanted escorted back to his room. (redacted) stated she escorted him back to Bryant’s room. She stated the tour took about 15 minutes.I asked (redacted) anyone saw her alone with Bryant. She stated the night auditor “Trina,” and a regular group, the Chipkowski’s (uncertain of the spelling of the last name.)(redacted) stated she entered Bryant’s room. She stated he closed the door. She stated he to sit on the couch and he sat on a chair adjacent to her. She stated they chit chatted for several minutes. More specifically, they talked about the tattoo on her ankle.He made the comment that he didn’t have a tattoo.(redacted) stated Bryant invited her to sit in the Jacuzzi with him. She stated he kissed her mouth and neck. She stated this lasted for about 5 minutes.(redacted) stated she agreed to this because there was flirting going on between her and Bryant. She stated he would give her compliments and she would flirt back by telling him thank you. She stated she was excited that Bryant seemed to be showing interest in her and this was somewhat flattering.(redacted) after the kissing ended, Bryant began groping her. She stated he started touching her breasts and buttocks. She stated she wasn’t comfortable with this. She told him she needed to leave.(redacted) stated Bryant kept putting his hands under her shirt She stated that Bryant then put his hands under her dress. She stated he started rubbing her vagina and buttocks with his hands. She stated this occurred on the outside of her underwear.(redacted) stated Bryant put his hands around her throat and began choking her. She stated he wasn’t choking her so hard that she couldn’t breathe, but he had control of her. She stated he took off his pants. She stated she told him she needed to leave. He didn’t stop.(redacted) stated all of this occurred tor about 2-3 minutes. She stated he knew she was trying to leave. She stated every time she would move to one side to get around him, he would move in the same direction with her. She stated she began to give in at this point because she was fearful of what he may do to her. She thought possibly physical harm.(redacted) stated her and Bryant were standing in the living room near the couch. She stated me couch is up against a sidewall and the chairs are facing away from the main door. She stated Bryant bent her over one of the chairs in the living room. She stated he pulled up her skirt and pulled down her panties. She stated he inserted his penis into her vagina. She stated she was in front of him and he was standing behind her. She stated his penis was erect and was hurting her. She stated this lasted tor about 5 minutes.(redacted) stated during the sexual intercourse, he would have one of his hands around her neck. She stated at one point, he leaned over and said, “You’re not gonna tell anybody, Right” She told him she wouldn’t. She stated she said this because she was in fear for what may happen to her. She stated during the intercourse, she was crying.(redacted) stated that during the intercourse, Bryant told her he likes Vail, CO. She stated he also asked her if she liked it when someone [sex act] . She stated she told him no. She stated he then stopped performing sexual intercourse on her.(redacted) stated she turned around and pulled her panties up. She stated he told her, “Nobody’s gonna know. You’re not going to tell anybody.” She told him she wouldn’t. Once again, she stated she was in fear for her safety.I didn’t observe any red marks on (redacted) throat I asked her is she was injured in any way. I said more specifically, was she injured vaginally. She stated she was injured vaginally. She stated she bled a small amount. She stated that she never told Bryant he could have sex with her. She slated this was completely non consensual.(redacted) stated after she was dressed and ready to leave Bryant wouldn’t let her leave the room until she calmed down. She stated he made her wash her face. She stated she waited five minutes and left. She stated when she entered BryaJit’s room to the time of exit was about 20 minutes. She stated she thinks she went into his room around 2300hours and left around 2320 hours.(redacted) stated Bryant was wearing a white t-shirt, blue nylon track pants and tennis shoes. She stated she was wearing a one-piece black dress, black blazer, shoes and panties. She stated she wasn’t wearing nylons.(redacted) described Bryant as being approximately 6’05” tall, weighing approximately 190 pounds, with a shaved head and unknown eye color.She stated Bryant did not use a condom. She stated she also doesn’t know if Bryant ejaculated inside her. She stated she hasn’t showered or douched since yesterday (06/30/03.) morning.(redacted) told me that Bryant told her when she escorted him to his room earlier, that if she wanted an autograph she would need to come back later. She stated he showed her a pen and paper when he was telling her this.Before Deputy Rich and I left (redacted) residence, she consented to giving us the clothes, she was wearing on she night of the alleged incident. There we collected her dress, shoes, panties, bra and vest. I also examined the panties since (redacted) stated she bled. There appears to be a brownish colored substance near me crotch of the g-string panties that appears to be consistent with dried blood.I requested the assistance from the Eagle County Crime Response Team to determine if Bryant was still at the lodge or even still in me valley.Page#4ECS03204-0069Narrative/Comment Sheet for SO-03-1169 06/30/2003TITLE: Supplement Det Winters 03-1169. By; mikeESCO (redacted), ECSO (redacted) and Vail PD (redacted) all with the response team, responded to the lodge. About an hour after they arrived,(redacted) advised your Affiant they located Bryant. She advised Bryant was on crutches. She could not tell me why Bryant was on crutches,however, I had knowledge that Bryant was in the valley to go to Steadman/Hawkins clinic for some type of rehabilitation. This information came from (redacted).ECSO Detective Dan Loya and Deputy Rich interviewed Robert Pietrack (redacted) ex-boyfriend Matthew Herr at the Eagle County Sheriffs Office. Both interviews were audio taped. The audio tape was placed into evidence. SEE DETECTIVE LOYA’S SUPPLEMENTAL REPORT FOR DETAILS.(redacted) agreed to have a sexual assault examination kit performed on her. ECSO Detective Lieutenant Mike McWilliam escorted (redacted) and her parents to Valley View Hospital in Glcnwood Springs, CO for the examination.Before (redacted) went to me hospital, your Affiant asked her if she was telling the truth. I also asked her if she knew the difference between the truth and a lie. She stated she does and she was telling the truth. I explained the consequences if she was making this allegation up. I explained to her I would charge her if she was lying to me. She slated she was telling the truth- She agreed to take a polygraph examination if she needed to.At approximately 2020 hours on 07/01/03 Detective Lieutenant Mike McWilliam contacted me about the results of the examination. He allowed me to speak with the Sexual Assault Nurse Examiners Nurse Lauren Gueriera from Valley View HospitaL She stated there were tender and red areas in the vaginal area. She stated there were 2 tears (lacerations) on (redacted) posterior fourchette. She stated there were 2 tears ofapproximately 1 cm each. She staled there were several 2mm tears in the same region.Nurse Gueriera stated thai the injuries appear consistent with penetrating genital trauma. She stated the injuries are recent, but could not say how recent. She stated the injuries are consistent with the statements given by (redacted).She said there was no cervical bleeding that would indicate (redacted) was having her period. She stated she did collect the panties (redacted) was currently wearing since they found what appears to be blood in them.(redacted) had already given your Affiant me pannes she was wearing on 06/3 003.I had Robert Pietrack and (redacted) recontacted about the issue of Bryant on crutches. Both parties stated Bryant was not using crutches on 06/30/03 when Bryant checked in.I applied for and received a Search Warrant for room #35 at the Lodge at Cordillera. The warrant was for the blue track pants and the while t-snirt that (redacted) told me Kobe Bryant was wearing at the lime of the incident.I also obtained a Rule 41.1 court order for non-testimonial evidence. Judge Russell Granger did approve both warrants on 07/02/03 during the early morning hours.On 07/02/03 at approximately 0130 hours. Detective Loya, Deputy Rich. ECSO (redacted) and I met at the lodge, (redacted) stated that they did not observe Bryant leave at any time.(redacted) advised me that Bryant was now behind our patrol vehicle. Detective Loya and I proceeded to contact Bryant. At some point. Detective Loya activated a mini audio cassette recorder he had in his shirt pocket. The following information is only a summary of what was said. To add to this, the mini tape ran out on one side and needed to turn over. There will be a time delay in the interview. I also learned from Detective Loya that after the interview had ended, Bryant wanted to meet with some people with him, during this meeting. Detective Loya re-activated the cassette recorder.Detective Loya and I identified ourselves to Bryant. He acknowledged us. He kept asking what was going on? We explained to Bryant that there was a report made of an incident that was involving him that occurred the night he arrived at the lodge.Detective Loya and I asked Bryant if we could go to his room. We kept walking and he kept asking us what this was all about We stopped and explained to Bryant there was an allegation of sexual assault. I explained we needed to get his side of the story. He stated he didn’t know anything about it. He claimed this was going to ruin his career.We stood in the parking lot during this and the following exchange.We asked Bryant if he was with a female party on the night of 06/30/03. He stated he was with a female party who was showing him around the lodge. He claimed the female party’s name (redacted).Bryant stated he and (redacted) went back to his room after the tour was over. He stated she went into his room and they proceeded to a window. He stated she showed him where the bears come to his window.We asked Bryant what he and (redacted) talked about. Then another question was asked if anyone was in the room with them. He stated the only people in the room was just themBryant stated he and (redacted) “… just shot the shit” He stated she asked him what he’s here for and he told her he was there for his knee. He stated they also talked about tattoos. He stated she showed him one other tattoos, the one on her back. He asked, “Like what?”. We stated “like a hug, or a kiss, or anything like that”. He stated no to all questions. I then asked him bluntly if he had sex with (redacted). He said, “No.”Bryant asked if there was any way that he could settle this now. He stated if his wife found out about this she would be upset. We explained to Bryant (redacted) had a rape kit performed on her and we collected evidence. At this point, Bryant became more agitated, would not maintain eye contact, appeared to be nervous. We said we justwanted the truth. He then stated he did have sex with her (redacted).Before we went to Bryant’s room, we continued asking him questions. He stated the sexual encounter was consentual. He stated it was conseritual because she started kissing him.We asked Bryant if at any time (redacted) told him “no” or “stop”. There was a long pause. He stated he was thinking. He then stated the sex was consentual. I asked the question again if at anytime did she tell him no and that he didn’t hear her. He stated this time, “Absolutely not, absolutely not”.Bryant stated he was holding her (redacted) around her neck from behind. He stated he then started having sex from behind with hcr. He demonstrated this to us.Bryant was asked if he ever [sex act] in her (redacted) face. He stated, “Yes!”He stated she told him no and he stopped. We asked him how this conversation came about. He stated he likes to [sex act] in a girls face. He stated that was his “thing.”I asked Bryant how he thought this was consentual. After a long pause, he stated “how could this not be consentual”. I then asked him about after the kissing episode if any type of foreplay went on between me two of them. He stated there was foreplay. He admitted to grabbing her breasts, rubbing her vagina, etc. He stated she (redacted) wasdoing the same.During this conversation, I asked Bryant for consent to collect the clothing he was wearing the night of the assault. He agreed.Bryant stated she (redacted) gave him oral sex. He stated it lasted for about “5 seconds.” He stated he told her to get up. He stated she wasn’t “doing it right”. He stated he didn’t perform oral sex on her. He admits to not using protectionWe explained to him we would like to go to his room and discuss this issue further. We didn’t want to stand out in the parking lot and make any type of scene.While we were walking with Bryant to his room, we maintained small talk and asked some more questions. He stated she has to want something. He stated possibly money. Detective Loya then asked Bryant if he was willing to pay her if she was after money. Bryant slated, “I got to, I got to, I got to. I’m in the worse flicking situanon…”.Once in the room, Bryant went around the room and gave us the clothing he wore the night before. The exception was the shirt he was wearing. He slated that the shirt he’s wearing now, was the shirt he wore the night before. Bryant gave us [wo while T-shirts, a blue pair of track pants, and a white pair of underwear.During this portion of the interview in the hotel room, Bryant said most of the same things he already said in the parking lot outside.Detective Loya asked Bryant who initiated the sexual contact. There was a long pause. Bryant finally stated she wanted to have sex with him. He stated she gave him those “eyes.” He then told us to take that however we wanted. He stated they started kissing, then one thing led to another and they had sex.Detective Loya asked Bryant if he pulled her panties down. He stated he did because she lifted her skirt up so he could grab her butt.(redacted paragraph)Near the end of the interview. Detective Loya had turned off the audio recorder. Bryant made a comment to us about what (redacted) teammate does in situations like these. Bryant stated he should have done what (redacted) does. Bryant stated that (redacted) would pay his woman not to say anything. He stated (redacted) has paid up to a million dollars already for situations like this. He stated he, Bryant, treats a woman with respect, therefore, they shouldn’t say anything.I asked Bryant if he would be willing to submit to a sexual assault examination kit He agreed.Deputy Rich interviewed Trina McKay, night audit manager for the lodge, while we were interviewing BryanL Deputy Rich advised your Affiant the following:Trina stated she arrived at work around 2100 hours on 06/30/03. She stated she knew a VIP was arriving and (redacted) and Robert were excited for the arrival. She stated she didn’t know who the VIP was.That everything (redacted) toId me appears to be consistent with what Trina was telling me. She stated shedidnt observe anything different about (redacted) before (redacted) left. She didnt observe (redacted) crying or having recently cried.Trina stated she knows Bryant from seeing him on television. She stated he’s a basketball player.Deputy Rich gave some information that an incident may have occurred involving Bryant and (redacted) Trina stated she didn’t think (redacted) is telling the truth. She stated she thought (redacted) would be more upset. She stated (redacted) was only gone for about 10-15 minutes.Detective Loya and I advised Bryant that we were going to transport him to Valley View Hospital in Glenwood Springs, CO to complete the examination. We advised his people that were with him to follow us down there so they could bring him back to the lodge after the examination was complete. We left the lodge at around 0245 hours on 07/02/03.After the examination was complete, Bryant was released to his people that were with him.One of the SANE nurses who examined (redacted) had told me that (redacted) disclosed that she had oral sex with Bryant after the assault.On 07/03/031 spoke with (redacted) again. I wanted to ask her about some statements made that needed clarification.(redacted) stated she did not tell me one thing that she did tell the SANE nurse. She statedBryant told her to kiss his penis. She shook her head no to him. She stated he grabbed her head with his hands and forced her head to his waist She stated he pulled his penis out of his pants. She stated she kissed his penis.I asked (redacted) if she consented to this. She stated she did not She stated this occurred after the assault was over.I (redacted) why she never told Bryant, “no.” I also asked her what things did she do that would make Bryant realize that she wasn’t a consenting party to the sexual acts.She stated she would try to push him away from her. She slated she told her ex-boyfriend Matt Herr. She stated she told him she showered because she wanted him to get off her case about calling the police. She stated Matt wanted her to report this incident to the police but she didn’t want to. She stated she was telling the truth, she had indeed not showered prior to being examined.I advised (redacted) needed to come forward with everything that she could remember. She understood and stated she doesn’t recall anything else.I asked (redacted) if she knew Trina very well. (redacted) said she met Trina for the first time on the night of 06/30/03.
